Aggravated Assault / Burglary of Habitation Dismissal
The defendant met the owner of a residence when he was homeless. This individual was hoping to have a homosexual relationship with the defendant, so he allowed him to stay at his vacant rental property and also purchased him a phone. When the relationship went south and the defendant refused to leave the house the owner called the police and told them he was living in the house without permission and had threatened him with a knife. The defendant's sister was well aware of the affair having been present when the pair were together. Investigator Olivo was able to provide an affidavit regarding her knowledge of the affair and also had possession of the defendants phone which had messages that proved he was not a home intruder but actually involved with the homeowner. Our efforts resulted in a dismissal.
Client Success
Our client was defending an automobile accident in which the driver claimed serious injury to her arm and shoulder which prevented her from working. The client was suspicious since the damage to the individuals car was so minor, it didn't appear that the collision could have caused such an injury. During the course of a 3-day surveillance by investigator Hodge, he was able to video tape our injured party going to the grocery store, lifting bags and loading them in her car, along with working on her yard. We also filmed her at a chiropractic office she visited for just five minutes.
Surveillance Case Success
Our client represented a national store who was being sued by an individual who claimed she fell causing serious injuries to her legs. During our surveillance on this individual investigator Hodge filmed her going to work at a nursing home for 8 hour shifts on a daily basis. She was also filmed taking out large garbage cans to the curve and walking through stores shopping without any obvious impairment.
Criminal Case Dismissal
Our client was charged with assaulting his wife before the police arrived at his residence. Investigator Potts learned a family friend had witnessed the argument, which was not physical and video recorded the interaction between the defendant and his wife with her cellphone. She then left with the defendant who never returned. The proof that we were able to obtain indicating that the wife had seriously misled the responding officers resulted in a dismissal.
Murder Case
Our client was charged with the shooting death of an individual in the parking lot of an after hours club when the pair fought over a minor traffic accident in the parking lot. The defendant claimed that his adversary had pointed a weapon at him causing him to shoot him in self defense. The security guard at the location shot the defendant multiple times resulting in him being sentenced to a wheelchair for the rest of his life. When the police arrived the victim's gun was not at the scene.
While we were interviewing witnesses in the offense report Investigator Haywood was able to identify some witnesses who the police had not talked to because they had left before they arrived. These witnesses were able to provide us with information that the victim did have a gun and were able to identify the individual who took the gun before the police had arrived. One of the witnesses had a video on her phone showing that the defendant acted in self defense before he was shot by the security guard. We are scheduled for trial.
Non-Compete Litigation
When our clients purchased the business the seller signed a noncompete agreement to not operate any business similar to the one he sold for a two year period. When our client heard that the seller was back in business, Investigator Hopkins surveilled him on and were able to record him arriving at a competitive business each morning, opening the door with a key and remaining there all day while working. He will soon be served for the violation of the agreement he made at the time of sale.
Who's Your Daddy?
Our Client was contacted by a lady who informed him that when she had sex with him 40 years ago that she became pregnant with his son. She told our client she was able to verify the son's relationship to him through an ancestry search. The mommy was requesting lots of money for past child support and even wanted a new house. Investigator Potts conducted a social media search on the son and learned he smoked and where he worked. Investigator Will Hodge surveilled this individual and was able to obtain a cigarette butt which has now been forwarded with the lab along with our clients DNA to see if the allegations have any merit. We are all waiting for the results.
Murder / Accident / Suicide?
Our office was contacted by a lady who had received a call from the Medical Examiner's Office telling her that they had the body of her son giving her a Harris County case number. The mother tried to contact the Homicide division numerous times without ever reaching anybody. We were able to obtain the Public Information Report regarding the incident and learned that her son's body was found at a business location two and a half miles from her house. The mother had told us that her son had mental health issues and has a history of living on the street with other homeless individuals.
Investigators Kucifer & Peikert went to find video from business near the location that showed our client's son walking and eventually falling to the ground. We contacted the Homicide division and learned that they had never conducted a canvas and they were awaiting the toxicology results before they could rule the incident a homicide. Homicide Investigator thanked us for our report & the video that they should have obtained themselves.
